Right to Redeem > Does a debtor have a post-repossession right to redeem?

Short Answer:

Yes.

Explanation:

The UCC-Secured Transactions Article, Ala. Code §§ 7-9A-101 et seq. ("Article 9A"), gives the debtor a post-repossession right to redeem. Article 9A requires a secured party to give the debtor and any secondary obligor a reasonable authenticated notice of sale. Ala. Code § 7-9A-611(b). The notice of sale must include a telephone number the recipient of the notice may call to obtain the full amount that must be paid to redeem the collateral under Ala. Code § 7-9A-623. Ala. Code § 7-9A-614(1)(c). The statutory form of notice of sale explains that the recipient of the notice may get the collateral back at any time before the sale by paying the full amount owed (not just the past due payments), including permitted expenses. Ala. Code § 7-9A-614(3).
