Alabama has two statutes of limitation that could apply to an action on a debt arising out of a credit sale

  • Article 2. The Uniform Commercial Code - Sales Article, Ala. Code §§ 7-2-101 et seq. ("Article 2"), provides that the parties to a contract for sale must commence an action for breach of contract within four years of the cause of action. The parties may reduce the period of limitation to not less than one year, but may not extend it. Ala. Code § 7-2-725.
  • Limitation of Actions Chapter. The Limitation of Actions Chapter, Ala. Code §§ 6-2-1 et seq. ("Limitation of Actions Chapter"), provides that the statute of limitations for actions on contracts generally is six years. Ala. Code § 6-2-34(9). However, if the contract is under seal, the limitations period is 10 years. Ala. Code § 6-2-33(1).
