The Texas Office of Consumer Credit Commissioner recently created a resource page to explain how providers and brokers of sales-based financing can register pursuant to Chapter 398 of the Texas Finance Code. Chapter 398 regulates sales-based financing transactions by requiring registration of providers and brokers, cost of financing disclosures, limits on payment methods, and notice requirements in contracts, among other things.
Providers and brokers that are required to register in Texas have until December 31 to complete the registration process. Applications are to be completed using the Nationwide Multistate Licensing System, also known as NMLS. NMLS will provide a registration checklist starting on September 1, 2026.
Registration can be renewed annually between November 1 and December 31 of each year.
